Part 1 — Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Claim Commander AI website, applications, and services (collectively, the "Service"), operated by Claim Commander AI ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

Claim Commander AI provides software that helps restoration service providers and contractors prepare claim files, generate documentation, and communicate with insurance adjusters using artificial intelligence and automation tools. The Service is a software tool and does not constitute legal, insurance, or professional advice. You are solely responsible for reviewing, verifying, and approving any output before it is used or submitted to any third party.

3. Eligibility & Accounts

• You must be at least 18 years old and able to form a binding contract to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate, current, and complete information and to keep it updated.
• You must notify us promptly of any unauthorized use of your account.

4. Subscriptions, Trials & Billing

• Paid plans are billed on a recurring basis (monthly or annually) through our third-party payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
• Free trials, if offered, automatically convert to a paid subscription at the end of the trial period unless canceled beforehand.
• You may cancel at any time; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable.
• We may change pricing with reasonable advance notice. Continued use after a price change constitutes acceptance.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful, fraudulent, or deceptive purpose, including submitting false or fraudulent insurance claims.
• Upload content you do not have the right to use, or that infringes the rights of others.
• Attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service.
• Use the Service to generate communications that are harassing, defamatory, or misleading.

6. Your Content & License

You retain ownership of the data, documents, photos, and other materials you submit to the Service ("Your Content"). You grant us a limited, non-exclusive license to process, store, and use Your Content solely to provide and improve the Service. You represent that you have all rights and permissions necessary to submit Your Content, including any authorization required to process claim-related or third-party information.

7. AI-Generated Output

The Service uses AI to generate drafts, summaries, and documentation. AI output may contain errors or inaccuracies. You are responsible for reviewing and verifying all output before relying on or submitting it. We make no warranty that output will be accurate, complete, or suitable for any particular claim or purpose.

8. Intellectual Property

The Service, including its software, design, and branding, is owned by us and protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights in and to the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any conduct that we reasonably believe harms the Service or other users. You may stop using the Service at any time.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules. Any disputes will be resolved in the state or federal courts located in Texas, unless otherwise required by applicable law.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by posting the updated Terms with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.

3. AI Processing

To provide AI features, content you submit may be processed by our AI and third-party model providers solely to generate output for you. We do not sell your content, and we take reasonable measures to limit how third-party processors may use it.

• Service providers: vendors that help us operate the Service (e.g., hosting, payment processing via Stripe, analytics, AI model providers), bound by confidentiality obligations.
